Terms and conditions

These terms explain how our tracking, installation and subscription services work, and the responsibilities that apply when you use them.

1. About these terms

These terms apply to services supplied by Tracker Guard UK Ltd (“TrackerGuard UK”, “we”, “us” or “our”). They should be read with your quote, order confirmation or service agreement, which will set out the equipment, price, subscription and any special terms agreed with you.

By ordering or using our services, you agree to these terms. Nothing in these terms affects rights that cannot legally be excluded, including your statutory consumer rights.

2. Our services

We supply and professionally install tracking equipment for vehicles, fleets, plant and equipment. Depending on your chosen service, features may include live location, journey history, geofence alerts, activity notifications, timed controls and access through mobile or desktop devices.

We also install the Scorpion X-Series Immobiliser where it is suitable for the vehicle. The exact products, features and service level included in your order are those shown in your quote or service agreement.

3. Installation and access

You must give us safe, reasonable access to the relevant vehicle or equipment at the agreed time and location. You are responsible for confirming that you own it or have authority to approve the installation and use of the service.

An installation fee may apply. If an appointment cannot proceed because access, authority, the vehicle or suitable working conditions are unavailable, we may charge a reasonable rearrangement or call-out fee where this was explained before booking.

4. Subscriptions and payment

Tracking services are available on monthly or yearly subscription plans. Charges, billing dates and the minimum term, if any, will be shown in your quote or service agreement. Payments must be made when due using the agreed payment method.

If a payment is late, we may contact you, charge any reasonable fee stated in your agreement and interrupt the service. If payment remains outstanding for 30 days, we may disable the service. A reconnection fee may apply before access is restored.

5. Equipment removal and non-payment

If a disconnected service is not reactivated, we may require access to remove equipment that remains our property. A removal fee may apply. If you refuse reasonable access after we have given notice, you may be charged the full equipment cost of £80 per device, as set out in our existing service terms.

Nothing in this section allows us to enter private property without permission or lawful authority.

6. Cancellation

You may cancel by giving us at least 30 days’ written notice. Charges remain payable during the notice period, and any cancellation, equipment or removal charge will only apply where it is set out in your quote or service agreement and permitted by law.

We may suspend or end the service if you seriously or repeatedly breach these terms, misuse the service, fail to pay, or where we can no longer reasonably provide it. Where we end a prepaid service for another reason, we will consider a fair pro-rata refund for the unused period.

If you are a consumer, any statutory cancellation rights that apply to a distance or off-premises contract continue to apply.

7. Your responsibilities

  • Use the service lawfully and only for vehicles, assets and people you are authorised to track.
  • Tell drivers, employees and other relevant people about tracking where data protection or employment law requires it.
  • Keep your login details secure and tell us promptly if you believe an account or device has been compromised.
  • Keep your contact and payment information accurate and up to date.
  • Do not tamper with, reverse engineer or interfere with installed equipment or the service.

8. Availability and location data

Tracking depends on satellite signals, mobile networks, compatible devices, power and third-party systems. Coverage, location accuracy and notifications can therefore be delayed, interrupted or unavailable. Planned maintenance may also affect access.

The service supports vehicle and asset security, but it does not guarantee recovery or prevent every theft. It is not a replacement for insurance, safe working practices, emergency services or other appropriate security measures.

9. Liability

We are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for losses caused by matters outside our reasonable control, unlawful or unauthorised use, inaccurate information supplied by you, or failures in third-party networks and services that we do not control.

For business customers, we are not liable for indirect or consequential loss, loss of profit, revenue, business or opportunity, except where the law does not allow that exclusion. We do not exclude or limit liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be limited.

10. Privacy

We process personal data, including account and tracking information, as described in our Privacy Policy. You are responsible for ensuring you have a lawful basis for supplying information about drivers or other people whose data may appear in the service.

11. Changes to services or terms

We may update features or these terms to reflect legal, security, technical or business changes. We will give reasonable notice of a material change that affects an active paid service, unless an urgent legal or security reason requires a quicker change.

12. Governing law

These terms are governed by the laws of England and Wales. If you are a consumer, you may also have the right to bring proceedings in the part of the UK where you live.
